Terms and Conditions

1. Introduction

These Terms and Conditions govern the use of the platforms citytransfers.eu, citytransfers.io, and citytransfers.de (collectively referred to as "CityTransfers"), owned and operated by Waldemar Jimenez Alanis Kurierdienste, Am Sonnenhang 57, 32758 Detmold, Germany (the "Provider"). The platforms connect customers and carriers, facilitating transportation services. CityTransfers acts solely as an intermediary and is not the direct provider of these services.

2. Scope of Services

CityTransfers provides a marketplace where carriers offer transportation services, and customers can book these services. The Provider facilitates the connection between customers and carriers, retaining a commission on each transaction.

3. Payment and Escrow Services

3.1. Escrow Payment System: Payments are held by CityTransfers in escrow until the carrier completes the service. Once the service is confirmed, the payment is transferred to the carrier.

3.2. Payment Methods: Accepted payment methods include credit cards, PayPal, and other secure payment options via Stripe.

3.3. Commission: CityTransfers retains a commission from each transaction, deducted before the carrier receives payment.

4. Cancellations and Refunds

4.1. Free Cancellation: Customers can cancel bookings without cost up to 48 hours before the scheduled ride.

4.2. Partial Refunds: Cancellations between 48 and 3 hours before the ride qualify for a 60% refund, with 30% going to the carrier and 10% to CityTransfers as a commission.

4.3. Last-Minute Cancellations: Cancellations within 3 hours of the ride result in 70% being retained by the carrier, 20% refunded to the customer, and 10% to CityTransfers as commission.

5. Registration and User Accounts

5.1. Account Creation: Users must register to book or offer services on the platform. Users must provide accurate information during registration and keep their account details up to date.

5.2. Account Security: Users are responsible for maintaining the security of their login credentials. CityTransfers is not liable for unauthorized account access.

5.3. Account Termination: CityTransfers reserves the right to suspend or terminate accounts for violating these terms or engaging in fraudulent activity.

6. Use of Third-Party Services

6.1. Google Maps: CityTransfers integrates Google Maps to provide location-based services. By using the platform, users agree to Google’s Terms of Service and Privacy Policy.

6.2. Stripe Payment Services: Payments are processed through Stripe, Inc. By using Stripe, users agree to their Terms of Service and Privacy Policy. CityTransfers is not responsible for errors or security breaches that occur through Stripe.

7. User-Generated Content

7.1. Photo Uploads: Users may upload images to the platform, which will be displayed to other users, including customers, to enhance profiles and facilitate bookings.

7.2. License to Use: By uploading images, users grant CityTransfers a worldwide, non-exclusive, royalty-free license to use, reproduce, and display the content on the platform.

7.3. Content Responsibility: Users are responsible for ensuring that their uploaded content complies with applicable laws and does not infringe on intellectual property or privacy rights. CityTransfers reserves the right to remove any inappropriate or unlawful content.

8. Carrier Responsibilities

8.1. Service Quality: Carriers must provide services professionally and ensure they meet the quality standards expected by customers.

8.2. Compliance with Local Laws: Carriers are solely responsible for complying with all applicable local, state, and national laws and regulations, including those regarding licenses, permits, vehicle registration, and safety standards.

8.3. Licenses and Registrations: Carriers must obtain and maintain all required licenses, permits, and registrations necessary to offer their services.

8.4. Insurance: Carriers are required to maintain appropriate insurance coverage for their operations, including liability and vehicle insurance. CityTransfers is not liable for damages due to insufficient insurance.

8.5. Vehicle Condition: Carriers must ensure that their vehicles are roadworthy, properly maintained, and meet all applicable legal safety requirements.

9. Customer Responsibilities

9.1. Accurate Information: Customers must provide correct details when booking services, including pick-up and drop-off locations, times, and contact details.

9.2. Respectful Behavior: Customers agree to treat carriers respectfully and follow the carrier’s instructions during the service.

10. Dispute Resolution

10.1. Between Customers and Carriers: CityTransfers encourages users to resolve disputes directly. If a resolution cannot be reached, CityTransfers may offer to facilitate communication but is not liable for disputes between users.

10.2. Platform Support: If needed, CityTransfers can review documentation and help settle disputes regarding cancellations, service quality, or payments.

11. Prohibited Activities

11.1. Fraudulent Behavior: Users are prohibited from engaging in fraudulent activities, providing false information, or abusing the platform’s services.

11.2. Compliance with Local Laws: Carriers must adhere to local transportation regulations, and customers must not use the platform for illegal purposes.

12. Reviews and Ratings

12.1. User Reviews: Customers and carriers can leave reviews after completing a ride. Reviews must be honest and objective, and not contain offensive or illegal content.

12.2. Content Moderation: CityTransfers reserves the right to review and remove reviews that violate platform policies.

13. Termination of Services

CityTransfers reserves the right to suspend or terminate access to the platform for any user (carrier or customer) who violates these Terms and Conditions, engages in illegal activities, or abuses the platform’s services.

14. Platform Availability and Downtime

CityTransfers strives to ensure continuous operation of the platform. However, we cannot guarantee that the platform will always be available without interruptions or errors. CityTransfers is not liable for any losses or inconveniences caused by temporary unavailability or technical issues.

15. Refunds for Technical Errors

If a booking cannot be completed due to technical errors on the CityTransfers platform, the customer will be entitled to a full refund of any payments made for the service.

16. Carrier Service Standards

Carriers must adhere to high standards of professionalism and service quality. This includes punctuality, proper vehicle maintenance, and professional conduct toward customers. Any failure to meet these standards may result in penalties, including removal from the platform.

17. User Responsibility for Accurate Information

Customers are responsible for providing accurate information during the booking process, including pick-up and drop-off locations, times, and contact details. CityTransfers is not liable for issues arising from incorrect or incomplete information provided by the customer.

18. Price Dumping, Avoidance of Commission Fees, and Commission Structure

18.1. Prohibition on Price Dumping: Carriers are prohibited from offering services at prices significantly lower than market rates (price dumping) in an attempt to undercut other carriers or harm competition on the platform. Such activities may result in penalties, including removal from the platform.

18.2. Avoiding Commission Fees: Carriers must not attempt to avoid paying commission fees to CityTransfers by conducting transactions outside the platform or by manipulating the platform's pricing or payment systems. Any carrier found to be avoiding commission fees will face suspension or permanent removal from the platform.

18.3. Commission Structure Based on Loyalty Levels: The commission paid to CityTransfers is based on five loyalty levels, which are determined by the carrier's behavior, reviews, and yearly revenue. The loyalty levels are as follows:

CityTransfers reserves the right to evaluate and adjust a carrier’s loyalty level based on performance metrics, including customer reviews and yearly revenue.

19. Liability

19.1. Platform as an Intermediary: CityTransfers acts solely as an intermediary and is not liable for the quality or completion of services provided by carriers. Any issues must be resolved directly between the customer and carrier.

19.2. Service Availability: CityTransfers strives to provide consistent access to the platform but does not guarantee uninterrupted service due to potential technical issues or maintenance.

20. Data Privacy and Security

20.1. Google Maps Data: Google Maps may collect personal location data. Users consent to this collection and use by agreeing to Google’s Privacy Policy.

20.2. Stripe Payment Data: Stripe processes payment data securely and in accordance with GDPR. CityTransfers does not store sensitive payment information.

21. Intellectual Property

21.1. Platform Content: All content on CityTransfers, including images, text, and software, is protected by intellectual property laws. Users may not copy or distribute content without permission.

21.2. User Content: Users retain ownership of content they upload, but grant CityTransfers a license to use that content for the purposes of providing services on the platform.

22. Amendments to the Terms and Conditions

CityTransfers reserves the right to amend these Terms and Conditions at any time. Changes will be posted on the platform and communicated to users. Continued use of the platform implies acceptance of the updated terms.

23. Governing Law and Jurisdiction

These Terms and Conditions are governed by German law. Any disputes will be subject to the exclusive jurisdiction of the courts in Detmold, Germany.

24. International Users

International users agree that German law will apply to all matters related to the use of CityTransfers, regardless of their local jurisdiction.
